Arbitral Tribunal has no jurisdiction to deal with the case of the Philippines against China over claims in South China Sea The Arbitral Tribunal of the United Nations constituted under Annex VII of the 1982 UN Convention on the Law of the Sea, presided by Thomas Mensah, international maritime and environmental law advisor, is on its way to deal with the case brought about by the Philippines government against China.儲存倉 As a general principle, if one of the parties to the dispute does not appear before the tribunal — before making its award — the tribunal must first satisfy itself that it has jurisdiction over the dispute. This finding of the jurisdictional question can only be based on the provisions of UNCLOS. So when China has refused to accept the jurisdiction of the tribunal according to relevant provisions of UNCLOS, how will it decide its jurisdiction over this case? The basic reason why the Philippines has resorted to the Arbitral Tribunal is Article 287(3) of UNCLOS, which reads: “A State Party, which is a party to a dispute not covered by a declaration in force, shall be deemed to have accepted arbitration in accordance with Annex VII.” In principle, Article 287(3) is based on and limited by Article 286 of UNCLOS, which says: “Application of procedures under this section: Subject to section 3, any dispute concerning the interpretation or application of this Convention shall, where no settlement has been reached by recourse to section 1, be submitted at the request of any party to the dispute to the court or tribunal having jurisdiction under this section.” On the jurisdiction question, the Arbitral Tribunal will have to decide whether or not this case is “a dispute not covered by a declaration in force”. In other words, it has jurisdiction over a question that is a dispute in the legal sense and the dispute is “a dispute not covered by a declaration in force”. But China made a declaration under Article 298 on Aug 25, 2006, which says the Chinese government “does not accept any of the procedures provided for in Section 2 of Part XV of the Convention with respect to all the categories of disputes referred to in paragraph 1 (a) (b) and (c) of Article 298 of the Convention”. Therefore, none of the categories of disputes referred to in the said paragraphs of Article 298 of the Convention, including those concerning maritime delimitation, can be decided by any international tribunal without the consent of the parties concerned. The reason for these exceptions is not difficult to understand. The compulsory procedures in the UNCLOS regime are applicable only to “any dispute concerning the interpretation or application of this Convention” (Article 286). And in cases in which there is no meaning to interpret and no rule to apply, such as articles 15, 74 and 83 of UNCLOS, there is no possibility of any international tribunal to adequately exercise its judicial function. The relief sought by the Philippines, which requests the Arbitral Tribunal to declare “that China’s rights in regard to maritime areas in the Sou迷你倉價錢h China Sea, like the rights of the Philippines, are those that are established by UNCLOS” is obviously not a dispute in the legal sense, because there is no conflict of legal views between the parties in this regard. For others, for example, to request the Arbitral Tribunal to declare “that China’s maritime claims in the South China Sea based on its so-called ‘nine dash line’ are contrary to UNCLOS and invalid” is obviously a question covered by “a declaration in force”. China’s maritime claims, conflicting with the Philippines claims, concern essentially the question of maritime delimitation, which undoubtedly are “disputes concerning the interpretation or application of articles 15, 74 and 83 relating to sea boundary delimitations” under Article 298 of UNCLOS. China has an indisputable right to refuse the jurisdiction of the Arbitral Tribunal based on the provisions of UNCLOS and the declaration it has made under Article 298. The Philippines’ request to declare the status of some of the maritime features is irrelevant for the purpose of imposing the jurisdiction of the Arbitral Tribunal, for these questions can only be decided after the jurisdiction of the tribunal has been justified. For the reasons given above, the Arbitral Tribunal should find that it has no jurisdiction to deal with the Philippines’ case. Nevertheless, it is not unlawful for the Philippines to invoke Article 287(3) of UNCLOS to raise its case. But the Philippines government has failed to fulfill in good faith its international obligations under Article 2(3) and Article 33 of the UN Charter. As Estelito P. Mendoza, a well-known Philippine legal expert, has highlighted, the present Philippines’ administration did not take any initiative “to settle the problem amicably among the countries with conflicting claims to the area, principally with China”. Estelito has said that all of Philippines’ efforts, including the filing of petition for arbitration, “have moved us away from the possibility of an amicable settlement of the problem. I would characterize these efforts as needlessly provocative, thus exacerbating the problem.” (Philippines Daily Inquirer, May 21, 2013.) Under general international law, while China is obliged to settle its disputes with other countries through peaceful means, it is not obliged to accept the jurisdiction of any arbitral tribunal to help solve its territorial and maritime problems. Moreover, according to UNCLOS, China has declared its unwillingness to accept the compulsory process for these problems. Hence, China has the legal right to refuse the jurisdiction of the Arbitral Tribunal. If the tribunal justifies its jurisdiction over the Philippines case, it will seriously violate the provisions of UNCLOS and China’s sovereignty. The consequences of this violation will be huge, so the arbitrators should exercise their judicial function wisely. Prosecutors said the target of the alleged plot was an undercover FBI agent who had posed as a terrorist in New York and supplied Daoud with what he thought was an explosive device to use in a terrorist attack in Chicago.After Daoud pleaded not guilty to the charges today, Durkin told reporters that the street gang leader approached Daoud in his cell last November while both were being held in the Kankakee County Jail, which often houses federal inmates awaiting trial in Chicago.As he has in the past, Durkin painted his client as a na鴳e and gullible teenager, saying the payment allegedly offered in return for the murder was "laughable.""It's an absurd plot on its face," Durkin said. Caulfield in Forest Hills on a range of gambling charges.McKeesport Councilman Daniel K. Carr, charged with two felony counts of corrupt organization and other offenses, said after his arraignment that he was "blindsided" and declined further comment.McKeesport Mayor Mike Cherepko said he was "deeply saddened with the revelations that former city employees and a current business owner, who also serves as a part-time city councilman, are apparently involved in this matter, but I have the utmost confidence in our judicial system and the investigating agencies involved."Mr. Cherepko said his administration has cooperated with authorities after a Dec. 11 raid by state agents, who confiscated 335 video gambling machines from roughly 70 locations, including bars, restaurants, bowling alleys, coffee shops, private clubs and convenience stores."I must, however, make it very clear that no one has provided me with any information that would indicate the City of McKeesport has any involvement in this matter whatsoever," Mr. Cherepko said.Dubbed Operation Pork Chop after the alleged ringleader -- 5-foot-9, 250-pound Ronald "Porky" Melocchi of West Newton -- the investigation revealed that Mr. Melocchi controlled a gambling, lottery and bookmaking operation through his Glassport-based business, Back Alley Vending, according to a grand jury presentment.Mr. Melocchi is charged with 57 offenses and is described in the presentment as being "known to law enforcement as a vendor of illegal vending machines."Mr. Melocchi's attorney, Bruce Carsia, said he had not had time to read the complaint."I don't believe that Mr. Melocchi was running any kind of corrupt organization," Mr. Carsia said. "At the same time, I'm not saying he wasn't involved in gambling or poker machines."Other prominent defendants are Mr. Carr, who owns the Viking Lounge in McKeesport; Mark Holtzman, Forward's police chief, who also is a member of the McKeesport Area school board; and Arthur Pero, a former McKeesport police lieutenant.State troopers seized video gambling machines at the Viking Lounge in November, the presentment said. A wiretap revealed Mr. Carr and Mr. Melocchi talking about replacing the machines."Dan Carr was frequently intercepted speaking with Ronald Melocchi about the plans for acquiring new stops, determining who may have been providing information to the Liquor Control Board, which resulted in the seizure of illegal machines and other aspects of Melocchi's business," the presentment said.Also charged were迷你倉新蒲崗a group of Mr. Melocchi's friends, Eugene "Red" Kowalski; Ronald "Eeky" Prest, a former McKeesport policeman; and Robert Bogesdorfer, who performs Frank Sinatra songs under the stage name "Bo Wagner."According to the presentment, those friends, along with Kirk Mollica and Frank Reese, collected money for Mr. Melocchi from various establishments that contained Back Alley Vending machines.Other defendants included owners of businesses that had Back Alley Vending machines and people accused of helping Mr. Melocchi in his day-to-day operations.Mr. Holtzman, who is a former deputy chief in McKeesport, ran the Coffee Pot, which was controlled by Mr. Melocchi and contained gambling machines, according to the grand jury.Mr. Pero accepted bets from an undercover state trooper inside the Coffee Pot, the presentment said.Observers in the Mon Valley believe authorities might be interested in issues concerning the intersection of gambling and political influence.Defendant Mark Novakovich, owner of the Twin Oaks Lounge in White Oak, told the Post-Gazette in July that four video poker machines were taken from his business by state police and agents from the attorney general's office.He said that during his appearance before the grand jury he was asked about "video gambling, video poker," but he refused to answer questions.Asked whether he was grilled about politics or campaign contributions, Mr. Novakovich said no, but then added, "We all know that's where this is heading."Mr. Melocchi's machines could be found in Allegheny, Fayette, Washington and Westmoreland counties, the presentment said.Operating out of a location in an alley behind a Glassport coffee shop, Mr. Melocchi placed the devices in various businesses and allegedly struck deals with the owners to split gambling proceeds.Video gambling machines are illegal if patrons pay to play, use more chance than skill to win, and are paid off.Business owners told the grand jury that they earned between $75 and $1,000 a week from the devices.Mr. Melocchi's federal tax returns showed gross receipts from Back Alley Vending of more than $300,000 a year for the past three years. Some revenue, the grand jury said, was from legal machines such as pool tables and jukeboxes.But on an intercepted phone call Mr. Melocchi was heard to say that Back Alley Vending "couldn't make it financially with just the legitimate machines," the presentment said.The scope of the investigation was laid out in a detailed grand jury presentment. The grand jury finished its work July 31, but the presentment was not made public until Thursday.Mr. Melocchi is known for his Mama Pepino's pizza shop, vending machine business and charitable work. It wasn't the lineup of events, since in its general contours the 2013-2014 season raises no eyebrows: 10 concerts from September through May, all but one of them on Sunday afternoon at the Lensic Performing Arts Center, plus another presentation in the Voyages of Discovery series the symphony gives in conjunction with the Santa Fe Institute. What looked strange was that the group's long-time music director, Steven Smith, would occupy the podium for only two of those concerts, with the rest of the season mostly divvied up among a handful of young conductors who are little known to the general public but who figure on the "names to watch" list of orchestra managements. It looked like an audition year.And that's exactly what it is. Gregory W. Heltman, the orchestra's founder and general director, confirmed to Pasatiempo that Smith's tenure "ended at the end of the most recent season." The parting of ways, he said, was unremarkable: "There's no scandal or anything like that. He had been our music director for 14 seasons, which is an extraordinary tenure; most music directors stay in their positions from five to seven years. This has been a positive artistic collaboration over a decade and a half. He serves as the full-time music director of the Richmond [Virginia] Symphony and of the Cleveland Chamber Symphony, and that created time constraints. This is an opportunity for him to spend the time he needed for those groups."Those facts are true, at least so far as they concern Smith's resume. He began his post in Santa Fe with the 1999-2000 season, at which time he was also working as assistant conductor at the Cleveland Orchestra. His affiliation with the Richmond Symphony dates to April 2010, and his contract there runs through the 2015-2016 season. The Richmond Symphony's website shows that he will conduct 16 performances there during the current season. The Cleveland Chamber Symphony, which he has directed since 2005, offers free concerts of contemporary music. The group has been limping along lately, apparently giving one concert in each of the past two seasons, and it currently is without a home concert hall. "I keep joking that our motto should be, 'We're not dead yet,'" Smith told Donald Rosenberg of Cleveland's The Plain Dealer in June. In the same interview, he expressed hope that the group might present a 10-day modern-music festival at various locations in northern Ohio in late March and early April 2014, although funding had yet to be located.The most unusual thing about Smith's departure from Santa Fe is the gradualness of its rollout. Even being gone, he's not gone. The symphony's website still lists him as the group's conductor, and, in fact, he'll be back in the capacity of guest conductor on Sept. 29 to lead Mozart's Don Giovanni Overture, Shostakovich's Violin Concerto No. 1 (with concertmaster David Felberg as soloist), and Beethoven's Symphony No. 3 -- and then he'll come back again on April 13 for Mahler's Symphony No. 7. That final concert (which looks as if it might fall at about the same time as the festival he's dreaming about in Ohio) seems an act of programming pluck of the sort that was largely lacking from Smith's tenure. Of Mahler's nine completed symphonies, the Seventh probably qualifies as the one the general public has embraced the least, for no good reason. I recall Smith expressing serious apprehension two seasons back when he was preparing to conduct in Santa Fe the Second Symphony of Sibelius -- one of the most familiar works in the symphonic repertoire. "We have talked about doing it for some time," he said, "but we have concerns that it may be out of the mainstream for some people." The step from Sibelius' beloved Second (first played in 1902) to Mahler's Seventh (premiered just six years later) is substantial, and one regrets that Smith is waiting until his final engagement to depart from the symphony's devotion to the ultrafamiliar.The Santa Fe Symphony's playlists have not lain entirely within the music director's purview. "Repertoire and programming were never solely his vision," Heltman explained. "They are the responsibility of a programming committee that consisted of seven musicians from the orchestra, me, Steven, the choral director, and two ex-officio members from the board who were supposed to provide the attendees' point of view. I'd get the calendar together, we'd have a broad sense of the budget we had to work with, and we'd kick around ideas and come to a consensus about whether to include something more experimental or unusual." He pointed out that the organization's whole concept of governance is not that of traditional symphony orchestras in which a music director exerts top-down control but instead approximates the more democratic model of such groups as the St. Paul Chamber Orchestra or New York's Orpheus, in which the musicians call most of the shots when it comes to personnel and repertoire.That will extend to the selection of Smith's successor -- who, it seems, will hold the title "principal conductor" rather than "music director," a change in designation that realistically implies the limited power the person will have in forming the group's artistic profile. "The principal conductor will have a strong voice," Heltman said, "not the final arbiter, but a leader of assuring artistic growth and excellence going forward." The selection of this leader will lie largely in the hands of the players, and the process could lead in several directions. "It may be that we find a candidate who is so multidimensional they can lead the various kinds of music we may present, but we're open to the possibility of doing things another way," Heltman said. For example, the group may select one person as principal conductor for the main symphonic programs, while also entering into official relationships with other conductors for pops programming and chorus-and-orchestra repertoire.The process will extend across multiple seasons. "After each is finished rehearsing and conducting their program," Heltman said, "they will be evaluated by the orchestra. If somebody comes out with a strong majority, they'll be invited back for a second appearance in a different sort of repertoire. After the second appearance, those finalists will have another evaluation from the orchestra. The entire process will take two or perhaps three seasons. The last time we went through this process, it took three seasons before we came around to Steven."Of this season's conductors, Smith is obviously not auditioning. Neither (Heltman suggested) is the orchestra's concertmaster Felberg, who on Nov. 2 leads the Vomini storageages of Discovery program postponed from last season, which is supposed to underscore the connection between music and mathematics. Tom Hall, director of the Baltimore Choral Arts Society since 1982, seems odd man out in the lineup. Considerably more senior than the others, his work is well known to the organization; he has appeared here in the past leading the group's annual performance of Handel's Messiah, which he will do again on Nov. 24. He returns on May 17 and 18 to lead Brahms' Tragic Overture and Beethoven's Ninth Symphony. He is officially listed as a candidate, but one imagines that the symphony is eyeing him more as an ancillary conductor for choral repertoire.That leaves Benjamin Rous, Joseph Young, James Feddeck, Robert Trevino, and Case Scaglione, all of whom are definitely in the running. Rous opens the season on Sunday, Sept. 8, at the Lensic. This is the symphony's annual Showcase of the Stars event, which is designed to bring in soloists you might possibly have heard of. In terms of repertoire, this year's go-round is duller than dishwater: Liszt's Hungarian Rhapsody No. 2, Rachmaninoff's Piano Concerto No. 3 (featuring Vadym Kholodenko, the most recent laureate of the Van Cliburn International Piano Competition), and popular morsels by Saint-Sa螚s and Sarasate (played by violinist Chee-Yun). Rous, whose background includes work as a violinist in historically informed performance while an undergraduate at Harvard, is currently associate conductor of the Virginia Symphony and prior to that was assistant conductor of the Phoenix Symphony.Young will lead a Christmas pops program on Dec. 15: again, hardly a test for serious technical fettle, but sometimes conductors get assigned to a certain repertoire niche not because they are essentially suited to it but rather because that's where they're getting the offers. A product of the Peabody Conservatory of the Johns Hopkins University, he went on to all the right conducting master classes and spent stints as assistant conductor for the Buffalo Symphony and resident conductor of the Phoenix Symphony.Feddeck takes on a more formidable challenge on Jan. 19: Mozart's pleasant little motet Exsultate, jubilate, but then Bruckner's massive Symphony No. 4 -- again, a piece we hardly expect to hear from the Santa Fe Symphony, a masterwork that will rise or fall on the conductor's ability to infuse it with logic and not let the orchestra wrest away the reins. Feddeck has just ended a term as assistant conductor of the Cleveland Orchestra, and in May he was honored with the Sir Georg Solti Conducting Award, a biennial prize awarded by the Solti Foundation U.S.The previous recipient was Scaglione, who is now assistant conductor of the New York Philharmonic. He'll be here on March 23 to lead Borodin's Polovtsian Dances (with the Symphony Chorus assisting), Bruch's Violin Concerto No. 1 (with soloist Clara-Jumi Kang, winner of the Indianapolis Violin Competition), and Rachmaninoff's Symphony No. 2.In between Feddeck and Scaglione comes Trevino, associate conductor of the Cincinnati Symphony, who has some experience in opera as well as in orchestral music; his program on Feb. 16 will include two pieces that have to do with Abraham Lincoln -- Copland's Lincoln Portrait (with N. Scott Momady narrating) and a suite of John Williams' music for the recent Spielberg film as well as a work by George Walker and Dvorak's Symphony From the New World.All of these contenders hold, or have held, positions as assistant, associate, or resident conductors at various orchestras. This is a standard step in the careers of developing conductors. People who hold these positions -- the titles are generally interchangeable, depending on the hiring organization -- typically conduct youth orchestras, oversee community events, serve as cover conductors (presumably prepared to fill in for a scheduled maestro at moment's notice), and may sometimes get an occasional scheduled date in the orchestra's subscription concerts. These candidates were all invited to Santa Fe thanks to personal recommendations. "If we had sent out an open announcement that we were looking for a conductor," Heltman said, "we would have gotten 500 or 600 applications. Instead, we sought input from people whose opinions we trust -- a musicians' grapevine across the country -- and drew up a list of perhaps 30 or 40 candidates. Then, of course, it was also to some degree a question of whose availabilities lined up with our schedule."Also on the shortlist are a few names we will probably see in the 2014-2015 season. David Danzmayr is just now beginning as music director of the ProMusica Chamber Orchestra of Columbus following three years as assistant conductor of the Royal Scottish National Orchestra. Alondra de la Parra, currently director of the Jalisco Philharmonic Orchestra, made her mark through the Philharmonic Orchestra of the Americas, which she founded when she was 23; it did not survive the economic downturn but attracted a good deal of interest prior to its demise in 2011. Michael Butterman is music director of the Boulder Philharmonic and the Shreveport Symphony as well as resident conductor for the Jacksonville Symphony Orchestra, but Heltman fears that another appointment he is poised to assume may render him unavailable. (We know he's in the running for the Charleston Symphony's music director position.) But it's the current tour he's looking forward to most.Cook and his band, Larry and His Flask, will get to head out on the road with Murder By Death for the first time."We've known these guys for a long time," he says during an interview from Richmond, Va. "But we never could get a tour set up together. We're so excited to be able to get out with them and experience this tour."The tour, which is an odd one, features the punk bluegrass sound of Larry and His Flask, teamed up with the indie rock of Murder By Death.Cook says it will be interesting to see how the two bands fare during the tour."Yes we do have different fan bases," he says. "But I believe that they will get it because our fans are music lovers, plain and simple."During the tour, Cook and crew will perform songs from their new album, "By the Lamplight." Barron took the job as Clark County's top administrator in 1998. During his time in Clark County, Barron helped build the Public Service Center, expand the county fairgrounds and lead the organization through a tumultuous and austere financial period amid the Great Recession.Former and current elected officials, county staff and members of the public said goodbye to Barron during an emotionally charged farewell ceremony on Thursday afternoon.The dozen who spoke -- including commissioners David Madore, Tom Mielke and Steve Stuart and former Commissioner Betty Sue Morris -- praised Barron for his integrity, attention to detail and work effort. He was called a teacher, a leader, a coach and a friend.Mielke called Barron a patient man for how he "tolerated, guided and mentored" the many "type-A personality" commissioners he served."And we all looked up to you," Mielke said.Barron, who is generally regarded as a stoic professional, took time to compose himself as a room of well over 100 people applauded. And after thanking everyone for their kind words, he delivered a final request to his staff."It is my hope that you, the employees of the county, will continue to make Clark County a great place to live, work and play," Barron said. "Thank you all."The exit interviewBarron sat down with The Columbian for an hourlong interview earlier this week to discuss his time with the county. When asked how he was feeling, he immediately became emotional."I feel very much at peace," he said before pausing. "There you go, you make me do this. I didn't think I was going to do this with you."After a brief chuckle, Barron composed himself and continued:"I'm at peace, and I'm overwhelmed by the good will that the entire organization has given me. I got all these cards and wonderful meals and words of good will. I had no idea, I truly had no idea how people felt about me, about my management style, about our accomplishments in the almost 15 years that I've been here. I knewintuitively that I was educated to do exactly what I was doing, and that my experience that I brought with me here would serve me well. And I know intuitively that we've done a good job in doing the things the commissioners wanted done over the years, but I had no idea of the depth of the feelings toward me. And I'm totally blown away by that. And totally satisfied. It's quite a feeling of satisfaction and accomplishment that what I was taught, and what I did, and how I formed my professional ethics means something to somebody besides myself."So are you really ready to retire?I think physically and psychologically, this is enough. My wife, and her life plan, and my life plan, our life plan has kind of been boxed out. We went to France two summers ago and we decided then that this is really what we want to do. Travel, go see people we know in different places, and be together. And I realized it would be 40 years (of working). I mean, how long does one work? When can one say, "it is a career"? I have done as much, if not more, than many others in my field. I feel very satisfied where I am in my career, and with what I've accomplished. Forty years is a long time, and I'll be 70 next year, and I just can't work 12 or 14 hours a day anymore. That's what I did. That's the norm. The other thing is when you don't live with your wife, you tend to work more. (Barron's wife, Jan, lives in Boise). I mean what do I have to go home to? An empty house. I just simply can't do that anymore. I'm satisfied. I'm at peace. I've made the right decision. My wife and I have made the right decision. It's time for me to retire.But you self storagetill seem to have mixed emotions on this, yeah?Yeah, but it's not a regret. It's a feeling of could I have done more for the people that are left in the organization. And the answer to that is I think I've done the best I can. But you always feel bad just because you're leaving a place, a person, a group of people and you say 'I'm going to miss you' but I think now it's a little more because it's so final. And in my case it's final and I'm moving away.You're kind of in a position here where sticking around would kind of make you a spectre for the next administrator, aren't you?Yeah, right. It's kind of a finality thing. That is kind of scary. I'm a person who loves, who built his whole career, who built his whole professional persona on relationships. And those are really important to me. And now, boom, many of them will never be touched again. Some will, I hope. But many won't. And that leaves a kind of empty space. Not that you could do anything, and not that you want to. But there's that feeling. A feeling of loss.What were some of the biggest things you faced here during your tenure as top administrator of the county?From an organizational point of view, the biggest challenge we had was keeping the fiscal solidarity in place. With the terrible recession in 2008, we kept ourselves balanced. We cut and we cut early and significantly with $62 million and 270 positions. Terrible experience, but something that had to be done. I'd say, overall, fiscal sustainability is the most important thing we've done to keep the organization in a good position.What are some of the biggest issues facing the county in the coming years?This is the year of the freeholders. Depending on how the group chemistry presents itself, I think they're going to try and get done in a year. That would be my hope for the county. We are Clark County at 450,000 people, the northern tier of a major metropolitan area, and we're still grasping for an identity, kind of. I think a part of that is "what is the structure of government?" I think we're at a crossroads in terms of the election and some of the policies of the board of commissioners. That has led to this outgrowth of the freeholder movement and the call for these freeholder elections. But the commissioners themselves put that on the ballot, so maybe we can speculate the commissioners themselves felt it was time for us to be restructuring our government.Commissioner Mielke said one of your greatest skills was how you tutored and taught commissioners. Commissioner Stuart has praised your counsel, as well. What are your thoughts on those comments?I think one at my age and experience hopes you are sought for your opinion and for your insights and knowledge. But one never knows if that happens. So for a commissioner to say that about a county administrator is the ultimate compliment. That means they sought you out and you have said something they appreciate and can use. When I was in my graduate work, I had an academic mentor who told us that if you call yourself a professional, then you must teach something to someone every day because ultimately what you are is a teacher. So if I am able to impart knowledge to someone, especially a commissioner, especially my bosses, then that is the ultimate thing a professional can do. Rosamma Joseph (47), working in the intensive care unit of the Mubarak Hospital, was thrown out of the vehicle as the over-speeding bus turned turtle after tyre burst, eyewitnesses said. Rosamma, an Indian national, sustained fatal wounds and died on the spot. She is survived by husband Joseph and two daughters Ashlin and Ansa.Of the ten injured, eight were being treated in Mubarak Hospital while two were taken to Farwaniya Hospital. The 22-year-old driver Dennis, who sustained minor injuries, was arrested. The bus, operated by Star Transport Abbassiya, was carrying night duty staff for 10 pm shift. The incident once again highlights the high risk to human lives posed by some private transport companies in Kuwait who allegedly operate 'unsafe vehicles' and employ 'inexperienced drivers' for financial gains."He was driving very fast to reach on time. Suddenly, we heard a loud thud from the rear side of the bus. Then the bus hit the concrete barrier on the left side of the road and spun out of control. There were cries and chaos," said one of the staff nurses on condition of anonymity.On hearing the news, a large number of people including spouses, colleagues and relatives of the injured, rushed to the Mu存倉arak Hospital late in the night. Expressing anguish and anger over the accident, they alleged that 'unsafe' and 'unroadworthy' vehicles being used by private transport companies and 'over-speeding' by inexperienced drivers are the main reasons for such recurring accidents.The owner of the transport company Raju (popularly known as Star Raju), who was also present at the hospital, however, refuted the claim that the company used bad tyres for their vehicles. "We installed brand new tyres for this bus three months back," he said, seeking to assuage the feelings of the aggrieved relatives.Star Transport has a large number of buses in its fleet and provides transport services to nursing staff working in all the hospitals in Kuwait. Though, there were complaints that many of their buses are old and not maintained timely, they continue to ply on Kuwaiti roads risking the lives of many people, they pointed out."Many of their drivers are not experienced. I don't think many of them can cope with the peak-hour traffic on our roads. For them, it is just a race against time," said Shaji Joseph from Abbassiya. According to Johnson, another Indian expat, many drivers are hired on a daily wages basis. He was sent to the county jail without bail.In May 2010, he set fire to the site of the Old Whitehouse Flea Market at 952 State St., according to court papers.Perkins went to the abandoned structure, mixed diesel and oil, poured it in a puddle, and then left a trail of it into another room, and lit it with a match, documents state. Blanchard Jr. refused to grant a bond for Ronald Jin Pak, 48. Blanchard said he believes Pak, who has a history of mental illness, to be a threat to society."There's no indication what his behavior will be with or without medication," Blanchard said.Pak was arrested June 3 as he was leaving the Wells Fargo Bank at 489 Furys Ferry Road in Martinez.Pak entered the bank and stood at a table, but rejected assistance from tellers before leaving, District Attorney Ashley Wright said at Thursday's hearing. He returned and told a teller twice that he had a gun and told her to put money into a bag. Because the teller didn't have a bag, Pak asked her what to use. He didn't show a weapon, left without receiving any money, and was caught while driving away from the bank parking lot."He turned himself in and said he wanted to explain what happened," Wright said.Pak's attorney, Paul Balducci, said the immigration lawyer has a long history of bipolar and manic depressive disorders. He is in the process of迷你倉surrendering his license to practice law.Wright said that she knows Pak and that when he's medicated, he appears calm and appropriate. She is worried about dangerous and physically threatening behavior when Pak isn't on medication or on proper medication, she said.Pak has had several run-ins with the law, including a 1996 arrest in suburban Atlanta's DeKalb County for terroristic threats, which was reduced to a misdemeanor. He was indicted on three counts of aggravated assault against deputies trying to take him into custody on a commitment order in 1998. Those charges were dismissed after he received treatment and was stable.He was arrested for criminal damage to property after an incident at his mother's house in 2002.Elizabeth Ball, a psychiatric nurse who treats Pak at the Columbia County Detention Center, said Pak was severely depressed and would barely speak when he was arrested.
