Source: Pittsburgh Post-GazetteJuly 16--In a society still fractured along lines of black and white, Americans knew, going into the murder trial of George Zimmerman, that the eventual verdict would infuriate someone.self storageAnd so the acquittal Saturday of the Sanford, Fla., crime watch volunteer, whose father is white and whose mother is Hispanic, in the shooting death of Trayvon Martin, an unarmed black teenager, was followed by rallies the next day in various cities, including Pittsburgh. Most of those who took to the streets were orderly, yet outraged over a case in which a 17-year-old carrying nothing more than Skittles and a can of iced tea could be fatally shot without his killer being found guilty of a crime. The jury of six women, all but one of them white, did not beyond a reasonable doubt convict Mr. Zimmerman of second-degree murder or a lesser charge of manslaughter. The case stemming from the February 2012 shooting was infused with racial politics, but there was more to this tragedy than that. It also turned on how far a gun-toting crime watch member should go in monitoring an unknown person in the neighborhood, and it raised the question yet again of how to keep innocent citizens safe from a growing culture of guns.Mr. Zimmerman, who was on patrol that night in a community that had seen a rash of break-ins, told a police dispatcher during a 911 call that he spotted a teenager who looked suspicious. The dispatcher advised Mr. Zimmerman not to confront or follow the youth and that police would be on the scene. Instead, Mr. Zimmerman got into a scuffle with Mr. Martin and said later that he迷你倉shot him in self-defense.The jurors' assignment was to uphold the laws of Florida, through the prism of the case that unfolded in the courtroom -- not the one seen on the nation's TV screens or framed by the endless parade of talking heads. Without sitting through every minute of the trial, it is not fair for the public to take issue with how the judge and jury did their jobs. After the shooting, President Barack Obama injected himself into the case when he said, "If I had a son, he'd look like Trayvon." Yet on Sunday he offered perhaps the wisest counsel on the trial's outcome -- "we are a nation of laws, and a jury has spoken."Some have said the verdict calls for more conversation in this country. The president challenged Americans to ask "if we're doing all we can to widen the circle of compassion and understanding" and "if we're doing all we can to stem the tide of gun violence."We question whether "stand your ground" laws like the one in Florida and "castle" laws like the one in Pennsylvania, which expand protections for gun use, invite unnecessary violence and unexpected tragedy. We are concerned about crime in all neighborhoods, whether the victims or the perpetrators are black or white, young or old, rich or poor. And we are impatient for the day when the opportunities of good education and family-sustaining jobs will be truly available to all. This is the conversation America should be having after the verdict on George Zimmerman.Copyright: ___ (c)2013 the Pittsburgh Post-Gazette Visit the Pittsburgh Post-Gazette at www.post-gazette.com Distributed by MCT Information Services文件倉

Source: Chicago TribuneJuly 16--Haunted house movies only work if the people in the house are worth scaring.self storage Sounds stupid, but it's true, although let's be honest: Real estate is inherently frightening. You put all that money in and only Satan knows if it'll turn out to be a decent investment, or if you'll be able to afford what it takes to repair any undisclosed matters of basement seepage. The quirks and creaks of an old house are always good for gallows humor or a cold shot of dread. As I write this the fridge in our new/old residence is softly moaning like a distant foghorn. Is it the way the appliance sits on a slightly askew kitchen floor? Is it demonic? When a really good new horror film comes out -- something more about creative intelligence than executing the next grisly kill shot -- it's something of a miracle in this eviscerating post-"Saw" era. Old-school and supremely confident in its attack, "The Conjuring" is this year's miracle -- an "Amityville Horror" for a new century (and a far better movie than that 1979 hit), yet firmly rooted, without being slavish or self-conscious, in the visual language of 1970s filmmaking. Also like "The Amityville Horror," "The Conjuring" derives from an alleged true-life haunting, this one in rural Rhode Island, at an old house where terrible things happened and are happening still. The relative restraint of "The Conjuring" is a surprise given that the director, James Wan, made the first of the "Saw" films. A more apt reference point is Wan's recent, slow-simmer horror outing "Insidious," which, like "The Conjuring," took its time in establishing the ground rules. The script by Chad Hayes and Carey W. Hayes blends the tales of two families under extreme duress. Demonologists Ed and Lorraine Warren, the real-life ghost hunters played by Patrick Wilson and Vera Farmiga, investigate the strange goings-on in the riverside farmhouse owned by a family of seven (two parents, five daughters) headed by Roger (Ron Livingston) and Carolyn (Lili Taylor). Warning signs and troubling details abound, but subtly, in the opening sequences. The family dog won't go inside. The clocks stop every night at 3:07 a.m. Unexplained bruises appear迷你倉on the mother's body, and one of the daughters complains of someone tugging at her feet in bed. Then the ghost of a long-dead child appears to one of the girls in a mirror. The miserably out-of-tune piano found in the cellar plays ... itself. Before all that, though, "The Conjuring" begins with a bait-and-switch and an entirely different story set three years earlier, that of a devil doll in 1968 (the year of "Rosemary's Baby"!) terrorizing nurses in Manhattan. The doll ends up in the possession of the paranormal investigators played by Wilson and Farmiga. They have a young daughter of their own, who's no less vulnerable to demons and such than the Rhode Island girls living by the river.Shooting digitally but with great attention to practical and postproduction lighting and color effects, Wan and his cinematographer, John R. Leonetti, keep the "gotchas!" coming. Near the end, when the full-on possession is underway, "The Conjuring" starts to feel more familiar, and there's less downtime between thrills. (Wan's technique grows more obviously hysterical as the characters do.) Wilson, a solid actor, brings to the material a stalwart leading-man aura that's more serviceable than compelling on its own.But the movie belongs to the women, for once, and "The Conjuring" doesn't exploit or mangle the female characters in the usual ways. Farmiga, playing a true believer, makes every spectral sighting and human response matter; Taylor is equally fine, and when she's playing a "hide-and-clap" blindfold game with her girls, she's like a kid herself, about to get the jolt of her life.Wan shoots "The Conjuring" like a Robert Altman film, slip-sliding around the interior or the exterior of the old dark house in a series of slow zooms and gratifyingly complex extended takes. Might this movie actually be too good, in a slightly square way, to find the audience it deserves among under-20-somethings? Maybe. Maybe not. I hope not.mjphillips@tribune.comMPAA rating: R (for sequences of disturbing violence and terror)Running time: 1:52Opens: FridayCopyright: ___ (c)2013 the Chicago Tribune Visit the Chicago Tribune at www.chicagotribune.com Distributed by MCT Information Services文件倉

Source: The Telegraph, Alton, Ill. July 16--JERSEYVILLE -- Of the two lawsuits filed by local business owners against the city, one has been dismissed and the other is moving forward slowly after an abrupt break in the discovery process being conducted by the plaintiff's counsel. The lawsuits, filed by Robert M. Higgins, Cliff Coats, Kenneth Isringhausen, Tim Kuebrich and Tamara Sutton, allege officials have manipulated various ordinances in order to issue citations and levy fines relating to height of grass or weeds and accumulation of junk and trash on their properties."My clients are still experiencing ordinance violations, and they're still being targeted, if you will," said Springfield attorney Tom Kelty, who is representing the plaintiffs. "But one case involving an ordinance violation filed against Ken Isringhausen went to trial, and the court ruled in favor of Mr. Isringhausen."The court found there was no basis within the city code for the ordinance violation that was alleged in the complaint against Isringhausen."Jerseyville Mayor Richard Perdun has a different interpretation of the events that have transpired over the last several years."These people are guilty of a series of ordinance violations and this filing of a frivolous lawsuit is a way of retaliating against us," Perdun said.Filed on May 25, 2012, the first suit hinges on alleged violations of the Freedom of Information Act. The plaintiffs -- Higgins, Coats, Isringhausen, Kuebrich and Sutton -- filed the complaint for declaratory judgment and injunctive relief against Richard Perdun, in his capacity as mayor of the city of Jerseyville, as well as the city.On the plaintiffs' behalf, Kelty requested copies of all ordinance violation notices for the period from Jan. 1, 2009, through Dec. 20, 2011, along with copies of the records of all fines imposed and collected, among other documents, on Dec. 21, 2011.In the suit, Kelty asserts the plaintiffs' rights to file suit because they were unable to obtain copies of public records from a public body with the usage of FOIA requests, and that the city did not have a FOIA officer in place, as required by state statute."The one pending count claims that we didn't have a FOIA officer, but our City Clerk Cathie Ward has always been ours," Perdun said. "She's been certified through the Attorney General's Office, so we're hoping this count will be found unmerited also."As part of the routine discovery process, Kelty began to take the deposition of City Treasurer Diane Heitzig on May 22, "when issues arose and the deposition was recessed," Kelty said.During the deposition, Kelty said he wanted to substantiate Heitzig's duties, along with her knowledge of financial documents."These documents were what we were originally requesting, and it 儲存eemed logical that she, as City Treasurer, would know where all the documents were, so they could be properly identified," he said. "In her sworn testimony, she knew nothing about the financial documents at all. Essentially, her explanation of her duties is that she attends most City Council meetings and signs checks to pay bills, which is pretty unusual for a City Treasurer."The deposition lasted less than 30 minutes before the city's attorney, Charles Pierce of Belleville, stopped the discovery process, contending the questions being asked by Kelty were irrelevant to the proceedings. On June 19, Meyer ruled that the parties were to complete depositions and should contact the court with dates for pre-trial and trial.Kelty completed Heitzig's deposition on July 9, as well as taking the deposition of City Clerk Cathie Ward, with the aim of discovering where documents are located and who understands them."We're looking for documents that weren't originally provided by attorney Jeff McDonald (with Wittman and Lorton of Jerseyville, the city's attorneys of record prior to being replaced by Pierce on Dec. 12, 2012) in the response to the original FOIA request," he said. "This is a step in the process."Kelty said he anticipates that any additional depositions would be taken within the next two weeks. The plaintiffs also had filed a second suit, a complaint for declaratory judgment, writ of mandamus and injunctive relief, against Perdun, in his capacity as mayor, and City Commissioners Yvonne Hartman, Bill Russell, Glenn Ketchum and Andy Macias on Nov. 5, 2012. This suit alleged violations of the Illinois Municipal Code, the Open Meetings Act and the Local Records Act.On Jan. 18, 2013, Macoupin County Circuit Judge Joshua Meyer granted a motion to consolidate both cases. Then, on March 1, Meyer dismissed the plaintiff's complaints outlined in the second suit for lack of standing and failure to bring a cause of action within 60 days of the alleged violation."Naturally, we're disappointed that the case was dismissed," Kelty said. "But this hasn't deterred my clients at all; they are still as committed for many reasons to seeing this thing through with the city."The court stipulated on April 25 that the suit alleging FOIA violations was still pending. On May 8, a protective order concerning disclosure of attorney fees was prepared by Kelty and entered by the court by agreement of the parties."I'm not sure what the next steps will be (after the depositions are completed), but generally we're moving towards a trial date," Kelty said. "We just don't have a trial date yet."kbassett@thetelegraph.comCopyright: ___ (c)2013 The Telegraph (Alton, Ill.) Source: Milwaukee Journal SentinelJuly 16--Darius Simmons' mother testified Tuesday afternoon that she watched from her front porch as John Henry Spooner gunned down her son.self storage"As I turned around, Mr. Spooner was standing there in front of Darius," Patricia Larry said. "He got a gun and he pointed it at Darius."She said Spooner, 76, demanded that Simmons put his hands up, and the 13-year-old Darius complied. Larry said she asked the defendant why "he had that gun on (her) baby.""He told Darius that he's going to teach him not to steal," she said. "And he shot him.""I ran off the porch to my son," she said. "I checked for a pulse. I checked both of his wrists. He didn't have a pulse so I went to his neck, and it was very faint... I pulled up his shirt and I could see that he had a bullet hole."She said her son was unarmed and did nothing to provoke Spooner. The trial opened Tuesday with opening statements from prosecutors and the defense lawyers, noting the defense is not contesting the fact that Spooner shot the Simmons on the sidewalk in front of their homes on the city's south side. What is in dispute is why Spooner, who is white, did so, and whether he was in a mental condition to be held responsible for killing Simmons, who is black. That was the question at the center of opening statements delivered Tuesday in the Milwaukee County Circuit Court trial of Spooner on the charge of first-degree intentional homicide.Spooner admitted to shooting his next-door neighbor, saying in statements to police on the scene that he had reached a "breaking point" after his house was burglarized two days earlier. He suspected his teenage neighbor of carrying out the heist and gunned him down in front of his mother, who watched from the porch as Spooner shot her son from five feet away."The best piece of evidence you're going to see in this case is the murder," Assistant District Attorney Mark Williams said, referring to a videotape of the May 31, 2012, incident that left Simmons dead. "You're going to see the terror in Darius' face and you're going to see how cold-blooded and callous Mr. Spooner was. It's not TV, it's not the movies -- you're going to see the actual homicide on video."Tuesday afternoon, the prosecution displayed that evidence -- a video recording of the encounter between the defendant and the victim in front of their homes and the subsequent shooting -- recorded on one of Spooner's private surveillance cameras.Simmons is the first to enter the frame, seen moving a garbage receptacle around the sidewalk. Spooner then exits his front door and confronts his neighbor. As he brandishes his weapon, Simmons backpedals and Spooner shoots him. The victim then takes off running in the opposite direction, as the defendant takes another shot at him, this time from behind. When Williams displayed a photo of the victim's gunshot wound, Simmons' brother Theodore Larry and another family member left the courtroom in anguish. Simmons' mother, Patricia Larry, watched the proceedings Tuesday from the front row of the courtroom gallery.Theodore Larry said Tuesday afternoon he came downstairs on the morning of May 31, 2012, to find his mother in the frame of the front door, with Spooner pointing a gun at the doorway."I've never seen my mom like that," Theodore Larry recalled on the witne迷你倉s stand in the first day of testimony in Spooner's trial. "My mom told me (Spooner) had shot my little brother. She said 'you ain't going out there.'"Larry said he he ran out of his back door and found his brother lying on the curb. He was crying as he took his lifeless brother in his arms, he said.Spooner's attorney, Franklyn Gimbel, said he would not dispute the prosecution's factual narrative but would question whether his client truly had the intent to kill the victim. If convicted of homicide, Spooner will enter a plea of not guilty by reason of mental disease or defect. In addition to alleged mental illness, the 76-year-old is in poor physical shape, suffering from pneumonia, Gimbel said."What you will have to decide is whether the behavior of John Spooner was such that he had the intent to kill this young man," Gimbel said in his opening remarks Tuesday morning. "He did not."Following opening statements, the prosecution began calling witnesses, including Milwaukee police officers, neighbors who had witnessed the killing and Ald. Bob Donovan.Donovan had a conversation with Spooner over breakfast at George Webb Restaurant the morning of the shooting. At the time, Donovan testified, the defendant expressed dissatisfaction with how the police were handling a burglary of his home, for which he blamed Simmons, and said "there are other ways of handling these things," Donovan said. The trial comes on the heels of the Saturday acquittal of George Zimmerman in the killing of Trayvon Martin. Spooner's case has drawn attention for its perceived similarities to the Zimmerman case, in which the neighborhood watchman was alleged to have racially profiled 17-year-old Martin.Jury selection for the Spooner trial focused Monday on eliminating potential jurors whose consideration of the case might be influenced by their reactions to the Zimmerman verdict.Jonathan Safran, a private attorney representing Simmons' family, said he sees a clear "issue of profiling" and a "race component to (the case)," but that important differences distinguish it from the Trayvon Martin case, including the lack of a self-defense claim on Spooner's part.Williams did not focus his questioning Tuesday morning on alleged racial tensions between Spooner and the Simmons family. self storage
