Source: Albuquerque Journal, N.自存倉M.Sept. 26--REFERENCES TO GOLD -- even gold cannon balls -- treasure maps and excavations on top of a mesa are part of a dispute now playing out in state District Court in Santa Fe.Court documents refer to what's technically called "a non-destructive geological survey on Black Mesa," but emails in the court record suggest it is a search for gold.Well-known Espanola businessman Richard Cook, his daughter and another relative on Tuesday applied for a temporary restraining order against Gale Roberts of the Jackson, Wyo., area over what the Cook group calls "increasingly adamant, bizarre and aggressive behavior" by Roberts.Whether any gold has actually been found on Black Mesa appears to be a point of dispute. Gale Roberts -- who refers to himself as "The Gale Force" -- maintains in emails included in the court file that there is overwhelming evidence that gold was stolen from Black Mesa after Cook contracted to have the survey done.Nothing from the Cook group acknowledges or ever directly addresses whether the Black Mesa survey has anything to do with gold, but it does acknowledge that Roberts was initially part of the mesa survey team.The Cooks' court filing asks that Roberts be ordered to stay away from the Cook family residence and Espanola Transit Mix, one of Cook's businesses. It alleges that on Sept. 17, Roberts "accosted" Cook, 87, in the driveway of Cook's home and blocked Cook from pulling out of the driveway.An affidavit by Katherine Cook Fishman, a lawyer and Cook's daughter, says Roberts handed her father a copy of an email that insists "the Cooks had essentially ruined him and his family by not providing him access to Black Mesa in his quest to demonstrate that a crime relating to the theft of gold had occurred on that vast property, and that the Cook family members were conspirators in that theft and/or fraud.""I am concerned for the safety of my father as well as others," Cook Fishman wrote. "We have no business with Mr. Roberts."Emails and phone calls seeking comment from Cook Fishman, Roberts and Roberts' lawyer, Kathleen Kentish Lucero of Espanola, were not returned Wednesday.It's not specified in the court documents whether the Black Mesa at the center of the dispute is the large, well-known landmark south of Espanola near San Ildefonso Pueblo or some other spot with the same name.Cook Fishman's affidavit says the mesa is owned by Generation Next LLC, a Cook family enterprise.The restraining order application says that Generation Next hired an archaeologist with a company called Antiquity Encounter for the mesa survey and that Roberts was part of the Antiquity Encounter team.The team worked on Black Mesa from March to April, but the relationship between the rest of the team and Roberts "soured," the court filing states. Antiquity Encounter's leader notified Cook Fishman in April that Roberts was not to be granted further access to Black Mesa.Gold theft allegedAfter that, Roberts sent "voluminous emails" claiming other members of the team had stolen gold from Black Mesa and committed fraud against迷你倉him. As exhibits for the restraining order application, Cook Fishman attached the emails from Roberts -- one is 13 pages long -- and other correspondence.Roberts' messages complain that the Cooks never filed a police report after an "incriminating report" and "raw data" supported his suspicions of gold theft "on the top of Black Mesa." Roberts says the thieves "are out partying on your gold" while Roberts had been "robbed" of his life for months.A July 29 letter from Lucero, Roberts' lawyer, to Cook Fishman says there is "credible information" that the gold theft took place and that the thief "was intending to return to steal more gold."The perpetrator provided a false report to make sure "no one would put their hands on the located gold," Lucero wrote. She says Roberts is offering to pay for "a forensic investigation of the pertinent areas of Black Mesa."Roberts wrote in a recent email that he will hold the Cooks and the alleged thieves accountable "with every means I can that are legal, ethical and as Roberts wrote: "It certainly helps to have the story and a potential reward of Cannon Balls Cast in Gold. That really should be the attention-getter that I need in order to blanket the country seeking help.""I have provided you with EVERYTHING to prove that gold was stolen but the gold itself and you still just looked the other way," Roberts stated.Also in an email, Roberts warned Cook Fishman that "you have no idea as to what I may do in the middle of the night that surprises the (expletive) out of everyone when they crawl out of bed." The message adds that the Cook group "will have no idea what I may bring your way as I am as unpredictable as it gets and I have no boundaries what so ever (sic)."In a Sept. 17 letter to Roberts, Cook Fishman told him, "Mr. Roberts, please stop sending me the endless emails. It is getting you nowhere. If you sincerely believe a crime has been committed, by all means you should report it and have the proper authorities look into it."Roberts said in one of his emails that he knows he has to find the gold "to help me win a civil case against all of you."Funded gold find?Roberts maintains that he was a "50/50 manager" for the research on Black Mesa and his money financed the team's work. "I am the person who funded the operation that helped your father find the gold that had eluded him for so many years," Roberts told Cook Fishman.Roberts says the reason Richard Cook may be looking the other way when he's been the victim of the gold theft "may have something to do with treasure maps" that were taken from Forest Service land by one of the parties involved in the Black Mesa project "several years ago at the rest area just outside of Taos."In his planned litigation, Robert says, he will demand those treasure maps and also a letter and another map that Cook told Roberts about.
